1. HOW TO RECEIVE A GAME CARD: NO PURCHASE NECESSARY TO ENTER OR WIN. "Get It Done The BC Way Scratch & Win Game" ("Game") starts 1/2/08 and ends 7/31/08 or while supplies last, whichever occurs first. Game Cards are available two ways while supplies last: Either: (A) Receive a Game Card when you purchase a specially marked package of BC Headache Powder® or (B) Send a hand printed, self-addressed, properly stamped #10 envelope requesting a Game Card & Official Rules to: Get It Done the BC Way Game & Official Rules Request, PO Box 8089-G, Grand Rapids, MN 55745-8089 (VT residents only may omit return postage.) Requests must be postmarked by 7/31/08 and received by 8/7/08. Limit of one (1) request per outer stamped envelope. Typed, computer-generated, or otherwise mechanically reproduced requests or outer envelopes are not allowed. Entries become property of GlaxoSmithKline ("Sponsor") and will not be returned.
2. HOW TO PLAY: Each Game Card contains one (1) silver-covered square ("square"). Scratch off the square to see if it says "$100 Home Improvement Gift Card" or "$25 Home Improvement Gift Card." If you reveal one of these messages, you are a potential Winner depending on the message revealed. All Game Cards are subject to verification. See Rule 4 below.
4. PRIZES & ODDS OF WINNING: FIRST prize (100): One Hundred (100) First Prize Winners, after submission and verification of the Game Card, will each receive One Hundred Dollars ($100) that s/he may use for home improvement in the form of either an American Express® Gift Cheque or other nationally recognized Gift Card (hereinafter, both of which will be referred to as the Card.) ARV: $100 each. SECOND Prize (200): Two Hundred (200) Second Prize Winners, after submission and verification of the Game Card, will each receive a Twenty-Five Dollars Card ($25) that s/he may use for home improvement. ARV: $25 each.NOTE: Regardless of Card won, Card is not redeemable for cash nor is it transferable or substitutable except by Sponsor with one of equal or greater value. Additionally, the Card must be used in compliance with its terms and conditions and as allowed by law. Winners are solely responsible for the possession and/or use of his/her Card after being awarded the Card and Sponsor is not responsible for any misplaced, lost, or stolen Cards. Prize may not be redeemed for cash; nor is it transferable or substitutable except by Sponsor with one of equal or greater value. Federal, state and local taxes are the sole responsibility of the Winner. Total ARV of all Prizes: $15,000. Limit: One Game Prize per person or household address throughout the Promotion Period. Based on an anticipated maximum distribution of 300,000 Game Cards, the odds of winning a First Prize are 1:3,000; the odds of winning a Second Prize are 1:1,500; and the odds of winning a Prize are 1:1,000. Unclaimed Prizes will be awarded in a Second-Chance Scratch & Win Game Drawing (See Rule 5).
4. HOW TO CLAIM A PRIZE: If the square you have scratched off on your Game Card reveals the message "$100 Home Improvement Gift Card" or $25 Home Improvement Gift Card , you are a potential Winner of a Prize as described in Rule 3 above, subject to submission and verification. Please securely staple your Game Card to an 8½"x11" sheet of paper on which you have hand printed and signed your name, complete address, and daytime telephone number ("Game Card Submission"), and send it in a properly stamped #10 envelope, no later than 7/31/08, to: Prize Claim - BC Scratch & Win Prize Claim, PO Box 2032, Grand Rapids, MN 55745-2032 (keep a photocopy of the Game Card Submission for your records). NOTE: Prize Claims must be sent by registered, certified mail or other traceable service provider. All Prize claims must be received by 8/16/08 or they will be forfeited.
5. SECOND CHANCE SWEEPSTAKES: A Second Chance Drawing will be held approx. 8/31/08 to award any unredeemed First and/or Second Prizes To enter the Second Chance Sweepstakes, staple your non-winning Game Piece to an 8½"x11" piece of paper on which you have legibly hand printed your name, complete address, daytime telephone number and date of birth and mail in a properly stamped envelope to: BC Second Chance Sweepstakes, PO Box 1257, Grand Rapids, MN 55745-1257. All entries must be postmarked by 8/14/08 and received by 8/21/08. A Second Chance Sweepstakes will not be held if all First and Second Prizes have been claimed and awarded in the Game. Odds of winning the Second Chance Sweepstakes depend on number of eligible entries received and number of Prizes that were not awarded in the Game. Winners will be notified by mail within approximately ten (10) business days following the Second Chance Sweepstakes.
6. VERIFICATION: All Game Cards are subject to verification prior to award of Prize. Potential winning Game Cards are null and void and will be rejected if not obtained in accordance with these Official Rules and through legitimate channels or if any part is determined by Sponsor or its independent representatives, whose decisions will be final in all matters relating to this Game, to be illegible, reproduced, counterfeited, mutilated, altered, or tampered with in any way, or if any Game Card contains printing, production, typographical, mechanical, or other errors. Any person(s) attempting to forge Game Cards or any attempt to win by fraud in any manner may be prosecuted. Liability for a Game Card containing printing or other errors is limited to replacement with another Game Card, while supplies last. The number of Prizes awarded will be limited to those stated in these Rules. In the event of a printing or other error resulting in more winning Game Cards than the number of Prizes as stated in these Official Rules, a random drawing will be held among those holding such Game Cards to award the number of Prizes as stated in these Official Rules.
7. ELIGIBILITY: This promotion is open to all legal residents of the 50 United States and the District of Columbia, 18 years or older, except officers, directors, and employees (and members of their household and of their immediate families, i.e., parents, children, stepchildren, spouse, siblings and persons residing in the same household of such immediate family members) of Sponsor, its subsidiaries, affiliates, sales representatives, distributors, advertising/promotion agencies, and/or their affiliates, assigns or representatives (herein after referred to collectively as "Sponsor & Others"), and all other persons or entities associated with the development, administration, promotion, execution of, or supply to this Game.
8. GENERAL: By participating in this promotion, entrants agree to be bound by these Official Rules. By accepting Prize, each Winner grants Sponsor the right to use his/her individual name, address, photograph, and likeness for advertising, publicity & promotion purposes and for any other such purposes as Sponsor so determines, in any and all media worldwide without limitation, without further compensation or permission, except where prohibited by law. Sponsor & Others are not responsible for any liability whether directly or indirectly, including, without limitation, liability in connection with any injuries, damages or losses of any kind, whether direct or indirect, whether to property or person, including death, arising out of the acceptance, use and/or misuse of the Prize and/or participation in this Game; and they will be held harmless against any claims of liability arising directly or indirectly from any Prizes awarded. Sponsor is not responsible for postage-due, late, lost, counterfeited, illegible or tampered entries/mail. The interpretation of these Official Rules shall be governed by the laws of the Commonwealth of Pennsylvania. Any and all disputes, claims and causes of action arising out of, or connected with, the Game or any Prize awarded shall be resolved individually, and without resort to class action, in the appropriate courts in the Commonwealth of Pennsylvania exclusively. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or a party's rights and obligations, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules of any other jurisdiction. All federal, state and local laws and regulations apply. Void in Puerto Rico and where prohibited or restricted by law.
